In October 2013, Sheldon Lobel, P.C. represented the Whitney Museum of American Art in connection with violations issued by the New York City Fire Department for failure to have public assembly permits for art gallery spaces on the 1st, 2nd, and 3rd floors of the existing museum building. Sheldon Lobel, P.C. filed an appeals application with the Board of Standards and Appeals, appealing the determination of the Department of Buildings Technical Affairs Division that public assembly permits were required for these spaces, and DOB rescinded their prior determination. Sheldon Lobel, P.C. also represented the Whitney Museum in Criminal Court proceedings related to the Fire Department public assembly violations and successfully had two summonses dismissed.
