December 18, 2013 – The City Planning Commission voted to adopt proposed changes to the CEQR Type II list, amending Section 5-05 of Chapter 5 of Title 62 of the Rules of the City of New York to add exceptions for 13 types of actions that were not previously exempt from environmental review and therefore required preparation of an Environmental Assessment Statement. These exceptions include, without limitation and subject to certain prerequisites contained in the new rules, special permits for Physical Culture Establishments (i.e. fitness centers and spas) up to 20,000 gsf, special permits for radios and television towers, special permits to allow a building to exceed height regulations around airports and special permits for drive-through restaurants up to 2,500 gsf.
